Privacy Policy

NurseLink Healthcare (“NurseLink Healthcare”, “we”, “our”, or “us”) is committed to protecting the privacy and confidentiality of personal information collected in the provision of homecare services. This Privacy Policy explains how we collect, use, store, and disclose personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

1. Purpose & scope

This policy sets out how all NurseLink Healthcare employees, contractors, and stakeholders handle personal information related to the delivery of homecare services. It applies to:

  • Clients receiving care at home,
  • Their families and representatives, and
  • All staff involved in delivering or supporting these services.

The policy ensures our practices protect privacy while supporting safe, high-quality homecare.

2. Applicability

This policy supports compliance with:

  • Standard 8 of the Aged Care Quality Standards, and
  • The Homecare Code of Conduct.

3. Definitions

Client: A person receiving homecare services coordinated or provided by NurseLink Healthcare.

Personal Information: Any information identifying an individual, including health records, medical summaries, contact details, sensitive information (e.g., racial or ethnic background, religious beliefs), feedback, complaints, or incident reports.

Senior Leadership Team: Our CEO, CFO, COO, and department managers responsible for policy implementation and review.

4. Responsibilities

  • The Senior Leadership Team ensures the policy is reviewed annually through privacy audits.
  • All employees receive privacy and confidentiality training during induction and through annual performance reviews.
  • A full copy of this policy is available upon request.

5. Photos, Videos & Recordings

  • Photos, videos, and call recordings are treated as personal information.
  • Written consent must be obtained before capturing, storing, or sharing any images or videos of clients or employees.
  • Phone calls may be recorded for quality assurance and are stored for up to three (3) years.
  • Clients or employees may request access to recordings within a reasonable timeframe.

6. Collection and Consent

We collect only the information necessary to:

  • Assess eligibility for homecare services,
  • Provide safe and responsive care,
  • Monitor and review services, and
  • Comply with healthcare, and government reporting requirements.

Information we may collect includes:

  • Client and representative contact details,
  • Health status, medical history, and medications,
  • Service delivery records and monitoring notes,
  • Feedback, complaints, and incident reports.

Before collecting personal information, we clearly explain:

  • What information is required and why,
  • How it will be stored and used securely,

  • When and with whom it may be shared, and
  • The right to decline or limit consent.

Consent is provided via a Consent Form, with clients or their authorised representatives responsible for maintaining accurate and up-to-date information.

7. Employee Information

We collect employee information, including tax, superannuation, payroll, qualifications, resumes, and emergency contacts. Consent is obtained for collection, storage, and use.

8. Disclosure

Personal information is disclosed only:

  • For emergency medical treatment,
  • With the individual’s consent, or
  • Where required by law (e.g., mandatory reporting).

Any unusual disclosures require Senior Leadership Team approval.

9. Notifiable Data Breaches

If a data breach occurs that may cause serious harm, NurseLink Healthcare will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches (NDB) Scheme.

10. Other Reporting Requirements

Data breaches or relevant information may also be reported to:

  • Law enforcement agencies, ASIC, APRA, ATO, AUSTRAC, ACSC, ADHA, relevant government departments, professional associations, and insurance providers.

11. Monitoring and Review

The Senior Leadership Team reviews this policy annually, considering feedback from clients, employees, and stakeholders to ensure ongoing compliance with privacy and confidentiality standards.
