Welcome to NurseLink Healthcare. These Terms and Conditions (“Agreement”) govern the provision of homecare services by NurseLink Healthcare (“the Agency”, “we”, “us”, or “our”) to you, the client (“you”, “your”, or “Client”).

By using or accessing our services, you agree to comply with these terms and any updates we make from time to time. If you do not agree, you should refrain from using our services.

1.1 Purpose of the agreement

This Agreement outlines the responsibilities and obligations of both the Agency and the Client, including the scope of services, client rights, payment terms, and procedures for ending services.

1.2 Acceptance of terms

By engaging our services, you confirm that you have read, understood, and agree to these Terms and Conditions.

1.3 Modifications

We may update these terms at any time. Changes are effective upon posting to our website. It is your responsibility to review these terms periodically.

2. Definitions

  • Agency: NurseLink Healthcare, providing homecare services.
  • Client: The individual, family, or organization receiving homecare services.
  • Healthcare Professional: Any licensed nurse, caregiver, or allied health professional assigned by the Agency.
  • Services: Homecare support, including nursing care, personal care, disability support, and other allied health services tailored to the Client’s needs.

3. Scope of Services

3.1 Overview

We provide professional, compassionate homecare, including personal care, nursing support, assistance with daily living, and allied health services. Services are tailored to each Client’s needs.

3.2 Customisation

Services can be adjusted based on the Client’s medical requirements, preferences, and schedule.

3.3 Limitations

We do not provide emergency medical services, surgeries, or treatments requiring specialized hospital equipment. Highly specialized care may not be available.

4. Client Responsibilities

4.1 Accurate Information

Clients must provide complete and accurate information regarding their health, medications, allergies, and medical history.

4.2 Access to Residence

Clients must provide safe access to their home or facility, including keys, security codes, or other arrangements.

4.3 Safe Environment

Clients must ensure a clean, safe, and well-lit environment suitable for care. Services may be paused if the environment is unsafe.

4.4 Compliance

Clients must follow relevant health and safety regulations and cooperate with healthcare professionals by following prescribed medical protocols.

5. Agency responsibilities

5.1 Qualified professionals

The Agency provides trained, licensed, and certified healthcare professionals suitable for the services requested.

5.2 Supervision

Healthcare professionals are supervised to ensure care is delivered professionally, ethically, and safely.

5.3 Communication

We provide regular updates on care delivery. Clients are encouraged to contact the Agency with questions or service adjustments.

6. Payment Terms

6.1 Service fees

Fees are agreed upon before service commencement and may include hourly rates, packages, or flat fees.

6.2 Billing

Invoices are issued [weekly/monthly] and must be paid by the due date to avoid penalties or suspension of services.

6.3 Late payment

Late fees may apply for overdue payments. Services may be paused or terminated if payments remain outstanding.

7. Confidentiality & data protection

7.1 Client information

All personal and health information is confidential. Information will not be shared without consent unless required by law.

7.2 Data protection

We comply with applicable Australian data protection laws. Personal information is used only to deliver services and improve care quality.

7.3 Disclosure

Information may be disclosed to third parties only with consent or when legally required, including emergencies.

8. Termination of services

8.1 By client

Clients may terminate services with [X] days’ written notice. Outstanding payments remain due.

8.2 By agency

The Agency may terminate services immediately for breaches, unsafe environments, or non-payment.

8.3 Consequences

Clients are responsible for all outstanding invoices and any deposits paid.

9. Liability & indemnity

9.1 Agency liability

The Agency is not liable for indirect or unforeseen damages except where due to our negligence. Liability is limited to fees paid for services.

9.2 Client indemnity

Clients agree to indemnify the Agency for claims or damages arising from their actions or omissions.

10. Dispute resolution

10.1 Informal resolution

Clients are encouraged to resolve disputes directly with the Agency first.

10.2 Mediation & arbitration

If unresolved, disputes will go to mediation, and if needed, binding arbitration per [Arbitration Organization] rules.

11. Governing law

This Agreement is governed by the laws of Melbourne. Legal actions will be conducted in courts located in Melbourne.

12. Miscellaneous

12.1 Severability

If a provision is invalid, the rest of the Agreement remains in effect.

12.2 Assignment

Clients cannot transfer rights without Agency consent.

12.3 Entire Agreement

This document represents the complete agreement. Any changes must be in writing and signed by both parties.
